Important Supreme Court Victory and Attorneys’ Fees Awarded

As reported in the New York Law Journal, the Supreme Court of Queens recently held that a co-op building’s demand for an elderly couple to remove their air conditioner amounted to discrimination under Federal, State and City statutes.

After an evidentiary hearing of several days over two months, the Court wrote that the co-op’s actions and its continued defense of the case were discriminatory because it refused to make reasonable accommodations to afford the lady, who suffered from severe asthma, an “equal opportunity to use and enjoy her dwelling”.

Moreover, Pete Reid, together with Colin Kaufman Esq. of Adam Leitman Bailey, PC, convinced the Court that the couple was entitled to have their attorneys’ fees reimbursed by the co-op under a provision of the Fair Housing Amendment Act.

This was a significant victory, not least because after more than six years of litigation, the couple had incurred over $230,000 in attorneys’ fees.
